The administration of construction contracts in Malaysia is facilitated through
a standard form of contract. Administration of a construction contract means
to ensure that the contract is performed according to articles of agreement
and conditions of contract and within the framework of related laws and the
practices of the construction industry. In Malaysia, there are several
standard forms of construction contract. The most widely used by the
Government to manage its construction contract is PWD203A. Public Work
Department of Malaysia (PWD) is a government agency that is responsible
for the PWD203A Standard Form of Contract. The latest revised PWD203A
Form (Rev.1/2010) consists of 81 clauses. Due to this number of clauses,
the use of PWD203A has been claimed as a tedious task especially for
those who are not formally educated on contract and legal areas. The
circumstance is getting critical since some of the clauses in PPWD203A
cannot be interpreted individually and it should be used interrelated with
other clauses. In order to ease the used of PWD203A, PWD203A Ruler is
designated to help the user to make references towards clauses. It will
display all clauses and the correlation of a particular clause with other
clauses. With this feature of innovation, it is hoped that it can provide better
understanding among users in using PWD203A Standard Form of Contract. |
